These terms govern your use of this website and any services provided by Prosperum Digital Pty Ltd (“Prosperum,” “we,” “us”). By browsing this site or booking a consultation with us, you agree to these terms. If you do not agree, please do not use this site or our services.
1. Who we are
Prosperum Digital Pty Ltd is an Australian company providing advertising and publishing services to local businesses, experts, and creators, primarily under two offers described on this website: Local Lead Gen (video advertising for local service businesses) and Offer Publishing (a growth partnership that builds and monetises offers around a client's expertise).
2. Scope of services
Prosperum provides marketing and growth-partnership services, which may include (depending on the engagement): strategy and creative direction, video advertising production, paid media management on Meta platforms, offer and digital product development, sales page and email copywriting, booking and automation systems, and related positioning assets. The specific scope, deliverables, fees or revenue share, and timeline for any engagement are agreed separately in writing before work begins. Nothing on this website constitutes a binding offer of services or a guarantee of specific results. Outcomes depend on factors outside our control, including market conditions, ad spend, platform policies, and your own business operations.
3. Bookings and consultations
This website allows you to book an introductory consultation via our booking platform (GoHighLevel). Booking a call does not create a contract for services. It is a conversation to determine fit. Any paid engagement begins only once both parties agree to written terms covering scope, fees, and payment. We reserve the right to decline to work with any prospective client at our discretion.
If you need to reschedule or cancel a booked call, please do so with reasonable notice using the link in your confirmation email, or by contacting us directly.
4. Fees and payment
Pricing is not published on this website because our services are scoped individually per client. Fees, payment schedules, and any advertising spend (which is separate from our service fees) will be set out in a signed proposal or agreement before any paid work commences.
5. Intellectual property
Unless otherwise agreed in writing, all content on this website (including copy, design, graphics, and code) is owned by Prosperum Digital Pty Ltd and may not be copied or reproduced without permission.
For client engagements: any advertising creative, digital product, or funnel asset produced as part of a Local Lead Gen or Offer Publishing engagement is owned by the client per that engagement’s agreement, except for underlying tools, templates, systems, and processes developed by Prosperum, which remain our property. Specific intellectual property terms for an engagement will be set out in that engagement’s written agreement.
6. Third-party platforms
Our services and this website rely on third-party platforms, including GoHighLevel (booking and CRM) and Meta (advertising delivery). We are not responsible for outages, policy changes, or performance issues caused by these third-party platforms, though we will act reasonably to work around them.
7. Limitation of liability
To the maximum extent permitted by law, Prosperum Digital Pty Ltd’s total liability arising out of or in connection with this website or any services provided, whether in contract, tort (including negligence), or otherwise, is limited to the total fees paid by you to us for the specific service giving rise to the claim in the twelve (12) months prior to the claim. We are not liable for indirect, consequential, or special loss, including loss of profits, revenue, or business opportunity. Nothing in these terms excludes any guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law.
8. No guarantee of results
Marketing and publishing outcomes depend on many factors beyond our control. We do not guarantee specific lead volumes, sales figures, book sales, rankings, or revenue outcomes from any engagement.
9. Governing law
These terms are governed by the laws of Western Australia, and you submit to the exclusive jurisdiction of the courts of Western Australia for any dispute arising from these terms or our services.
10. Changes to these terms
We may update these terms from time to time. The effective date above reflects the most recent revision. Continued use of this website after changes take effect constitutes acceptance of the updated terms.
